When Am I Eligible to Make A Claim?
You can claim for compensation if:
- your deposit was not correctly protected, even if its been returned in full;
- If your Landlord did protect the deposit but did not provide you with the information as to how the deposit has been protected,
How do I know if my Deposit has been protected?
You can check each of the schemes via the following links.
- https://www.tenancydepositscheme.com/is-my-deposit-protected/
You will need to advise of your postcode, tenancy start date, deposit amount and surname.
If you go through all through schemes and the results are negative, then it is likely, your Landlord has not protected your deposit as required for them to do so.
What Evidence do I need?
To claim compensation, you will need: -
- Your tenancy agreement
- Evidence that you paid a deposit
- Any correspondence in which you have discussed the deposit between you and your Landlord
- Evidence that you have paid your rent
- Any evidence that you have searched the Deposit protection agencies
How much could my claim be worth?
If all of the requirements are not met, your Landlord may be required to repay the deposit in full and pay up to three times the amount of the original deposit.
Each case is unique, and we act on a case by case basis rather than a ‘one size fits all’ basis. As such, compensation can vary, however, we are able to give a rough estimate on what you may be entitled to: -
