What are my rights as a tenant?

Under the Protection from Eviction Act 1977 no tenant can lose their home due to unlawful and unfair acts by their Landlord. The law states that Landlords cannot evict you without the necessary court order being obtained.

What procedure should my Landlord follow?

  • Your Landlord must serve a Notice Seeking Possession or a Notice to quit. This will give a time period to vacate the property.
  • If you do not leave the property, they then must apply for a Possessions Order. This provides a date for you to vacate the property.
  • If you still have not vacated the property, the Landlord must then obtain a separate warrant of eviction, this will include an execution date. On this date court bailiffs can attend the property and execute the possessions order.
