Defending Possessions

Your Landlord must follow a procedure to regain possession of the property at the end or during your tenancy. If the correct procedure is not followed, it may be possible to prevent or delay the eviction.

A Landlord can commence possession proceedings in numerous circumstances such as:

  • Following the tenancy expiration
  • After the tenant has failed to pay rent
  • If the tenant has damaged the property
  • Anti-Social Behaviour
  • The Landlord wishes to reside in the property

If you have been served with a notice of eviction by your Landlord, such as a section 8 or section 21 notice, you may be able to defend the proceedings so you can continue to reside within the property.
